MONTICELLO August 22, 2003 Supreme Court Judge Nicholas Clemente on Monday dismissed the lawsuit filed by Democratic Board of Elections Commissioner Tim Hill against the county.
County Attorney Ira Cohen was notified of the decision yesterday. Hill could not be reached for comment at press time.
Last December, the legislature voted to eliminate Democratic elections clerk Mary Jo Oppenheim and Debra Gabriel, her Republican counterpart, in a budget-saving measure.
Hill minus fellow Commissioner Fran Thalmann, a Republican subsequently filed the lawsuit, seeking to have the positions restored.
Finding there are enough funds and personnel to run the Board of Elections, Clemente dismissed the suit.
